Overview
Germany introduced crypto custody business (Kryptoverwahrgeschäft) as a regulated financial service under the Banking Act (KWG) effective 1 January 2020, becoming among the first EU member states to license such activity. Entities that hold, manage or protect cryptoassets or their private keys for clients need BaFin approval; the supervisor has issued application guidance and a dedicated contact point. Following MiCA's entry into force in Germany at end-December 2024, crypto custody now falls under the EU-wide CASP licensing framework, and existing KWG licence holders must convert to MiCA authorisation.
